CAN I SEE MY PERSONNEL FILE?

Under Minnesota law, you have the right to view the personnel file your employer maintains. Listed below are answers to some typical questions about viewing your personnel file.

Q. Can I see my personnel file?

A. Minnesota Statute § 181.961 gives employees the right to view and obtain a copy of their personnel file.

Q. Is there a time limit by which my employer must give me a copy of my personnel record?

A. Minnesota Statute § 181.961 gives employees the right to view and obtain a copy of their personnel file within 7 working days after the employer receives a written request for your personnel record. If the employer maintains the record outside Minnesota, the employer must produce the personnel record within 14 working days after receipt of a written request.

Q. May I remove or revise information in my personnel record?

A. Minnesota Statute § 181.962 states that you may attempt to get agreement from your employer to remove or revise information contained in your personnel record. If this attempt is unsuccessful, you may submit, to your personnel file, a written statement that outlines your concerns.

Q. Do I have rights if my employer fails to comply with these statutes?
A. Minnesota Statute § 181.965 provides relief for an employer's violation of these statutes.
